Terms & Conditions

At present we can accept orders for delivery to Great Britain and Northern Ireland addresses only.

 

1) Products
a. The products shown on this Website are authentic to BREAK THE ICE & STORM and cover a selection of designs available through stores we supply to throughout the UK.
b. Product dimensions are approximate and for information only.
c. Colours shown are as accurate as Internet technology allows but there is likely to be / may be some variance due to the photographic lighting environment and also colours cannot be reproduced exactly on your monitor.
d. We may change product specifications, without notice, but please see our refunds policy below.

 

2) Terms of Purchase and Security
a. All orders are subject to stock availability and payment clearance.
b. We currently accept Visa, Mastercard, Switch and Delta through PayPal.
d. Online payment transactions will be processed using a secure credit card payment system (128 bit SSL via PayPal). This is one of the most commercially secure systems in use. In the unlikely event that unauthorised use is made of your card, the card issuers will normally cover the cost of all unauthorised use or limit your liability to £50.

 

3) Prices
a. Prices are recommended retail price. To this we add insured postage and packing charges of £3.75.
b. All prices include VAT, currently at the rate of 20%.
c. Payment is in Pounds Sterling only.

 

4) Delivery
a. We aim to despatch orders placed before 2pm weekdays the same day (during exceptional peak times, orders may be despatched the next day.)
b. UK Delivery - UK Orders are normally delivered within 3-5 days.
     * depending on stock availability,
     ** UK destinations except postcodes
     - GY1, GY9, HS2, PA61, PA62-75, PA78, ZE2-3. :- 2 day delivery
     - KW16-17, PH30, PH41-44 :- 3 day delivery
     (Channel Islands & Isle of Man may be delayed by Customs)
c. All Parcels will be despatched by Royal Mail Signed For.
d. You will be asked to sign for the delivery and this will be used as proof of delivery. If someone without authority signs for the product at the address you have given us, then this will be your responsibility.
e. If there is likely to be a long delay, for example if our warehouse is awaiting stock, then we will notify you. You can then cancel within 7 days and obtain a full refund by emailing or writing to us. Provision of the refund will discharge us from any and all liability for failure to deliver items ordered or to deliver them within the stated period. If you choose not to cancel and wait for delivery instead, we will try and achieve this quickly, but cannot accept any liability for failing to do so as fresh stock sometimes takes a few weeks to reach our warehouse.
f. Parcels are dispatched Weekdays Monday to Friday (barring bank holidays), however orders may be processed including a "Dispatched" email being sent outside of these times. If this is the case then the parcel will be dispatched during the next working day.

 

5) Returns
a. We believe you will be totally satisfied with your purchase. If in the unlikely event you are unhappy with your purchase you may return the product to us for a refund. However this refund is not available if we reasonably expect that the item has been worn or the product is returned without its original packaging, including the clear protective wrap, or if you don't include your receipt. Alternatively you may ask for an exchange for the same or a different model. An exchange does not apply if we expect that the item has been worn or damaged in any way. If you are changing models, then there may be a price differential to be accounted for.
b. Your request for a refund must reach us within 14 days of receipt or within 28 days for an exchange.
c.In the unlikely event that you receive your item(s) in a faulty/damaged state, please notify us within 7 days of receipt, these items will be dealt with in accordance with our returns procedure. Please note that refunds and exchanges do not apply if we reasonably expect that the item has been worn or damaged in any way.
d. Refunds and exchanges for Internet purchases on STORM sunglasses cannot be obtained from STORM stores. Please inform us of any query by e-mail and return the items by post to: Break The Ice Limited. 727, Capability Green Luton, Bedfordshire LU1 3LU.
e. We aim to make the refund or exchange within 10 days of receipt of the returned goods. Refunds will be made in the same form as the original payment.
f. We will deduct the cost of post and packaging (outwards and, if relevant, inwards) from the refund amount if you return the product due to personal preference, as opposed to some defect with the product. This also applies to transactions where free delivery was the chosen transportation method.
g. Any items which have been customised by ourselves or by a 3rd party cannot be returned/exchanged on preference grounds only. They are still covered by the guarantee.

 

 

6) Warranty

BREAK THE ICE LTD warrants that at the time of delivery the Goods will be free from defective design, workmanship and materials having regard to the price, other commercial terms and the specification and description of the Goods (“Product Defects”) provided always that: (a) if the Goods are supplied with an individual product warranty then BTI will honour that product warranty in accordance with its terms; and (b) in all other cases BTI will at its discretion repair, replace or refund the price of the Goods that have the Product Defect if: (i) the relevant Goods are returned to BTI with proof of purchase from BTI within 15 months of the date of delivery to the Customer; (ii) the Product Defect was not caused by the improper use or maintenance of the Goods or fair wear and tear; and (iii) the Customer shall be responsible for its own costs of returning the relevant Goods to BTI.

 

7) Data Protection / Privacy / Emails
a. We take protection of your privacy and data seriously and recognise our duty to keep information about you safe and secure.
b. For fuller description on our approach to these issues, please see our separate Privacy Policy on this Website.
c. By "Checking Out" from our Shopping basket, and therefore Pressing OK to agree with our Terms and Conditions.

 

8) Design and Trade Mark Protection
a. We pride ourselves on our innovative designs and go to great lengths to create products that are unique.
b. All our products are protected against copying by domestic and international law. We reserve all of our rights concerning our trade marks, copyrights and designs. Copying of any product in any form will be an infringement of our intellectual property rights and is strictly prohibited.

 

9) General
a. We may amend these Terms and Conditions from time to time without notice.
b. There may be mistakes, inaccuracies or other errors in the information on this Website. For example the information may be out of date or incomplete in some way. If there is an aspect of your purchase that is particularly important to you, which will not be covered by our Return Policy, please call us and we would be happy to help.
c. BREAK THE ICE LTD is not responsible for the content of any external websites we link to.
d. This site is being hosted and made available to you from England. English Government and the Courts of England have exclusive jurisdiction.
